1. You
hereby grant to BeeGeesReviews.info and
persons authorised by us the exclusive right
in perpetuity to publish, record, copy,
reproduce, broadcast, transmit and perform
all or part of the Material (as defined in
paragraph 2 below) for and/or in connection
with the publication, production,
exploitation, promotion and/or advertising
of the BeeGeesReviews.info throughout the
world by all means and in all media whether
now known or hereafter discovered or
developed (including without limitation
publication on the internet, broadcasting by
television and inclusion in cable
programmes).
2. For
the purposes of these Terms and Conditions,
“the Material” shall mean any review
submitted to BeeGeesReviews.info or
joylandbooks.com for consideration that has
been accepted by BeeGeesReviews.info or
joylandbooks.com and for which payment has
been made to the Author.
3.
You warrant that you are entitled to grant
to us the rights referred to in paragraph 1
above and that the exercise of such rights
will not (a) infringe the copyright or any
other personal or property rights of any
person or (b) entitle any person to claim
any payment from us or from any of our
licensees.
4.
In recognition of the needs of website
publishing, we shall be entitled to edit,
copy, add to, take from, adapt or translate
the contribution as we see fit and, in
respect of the Material, you irrevocably
waive the benefits of and agree not to
assert any provision of law known as "moral
rights" or any similar laws of any
jurisdiction.
5.
In full consideration for all rights and
benefits hereby granted we shall pay to you
the sum of £0.50 (the receipt and
sufficiency of which is hereby acknowledged)
for each album review submitted to
BeeGeesReviews.info or joylandbooks.com and
accepted by BeeGeesReviews.info or
joylandbooks.com provided that if we do not
include the Material on the Website we shall
have no liability to pay you the sum
referred to in this paragraph.
6.
We shall not be obliged to include the
Material on the Website.
7.
We shall be entitled to assign the benefit
of this agreement to any third party but we
shall remain liable to you for all of our
obligations under this agreement. Your sole
remedy for breach by us of our obligations
hereunder shall be an action at law for
damages and you acknowledge that damages are
fully adequate to compensate for any breach
by us, our licensees and assigns.
8.
This agreement shall be governed by and
construed under the laws of England and
Wales.
Definitions
'the Author' is anyone who submits a review
to BeeGeesReviews.info or joylandbooks.com.
'the Material' is any review submitted to
BeeGeesReviews.info or joylandbooks.com for
consideration that has been accepted by
BeeGeesReviews.info or joylandbooks.com and
for which payment has been made to the
Author.
'the Website' is BeeGeesReviews.info,
BeeGees.co.uk or joylandbooks.com.
'We' is BeeGeesReviews.info, BeeGees.co.uk
and joylandbooks.com. |
